1. Acceptance of These Terms
These Terms of Service (the “Terms”) form a binding agreement between you and Aviation Learning Solutions LLC, a Michigan limited liability company (“Aviation Learning Solutions,” “we,” “us,” or “our”), governing your access to and use of the Aviation Learning Solutions A&P study platform, including our website, web application, and any mobile application we make available (together, the “Service”). By creating an account, starting a free trial, purchasing a subscription, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.2. Eligibility and Your Account
The Service is intended for users who are at least 18 years old. A user under 18 may use the Service only (a) with the involvement and consent of a parent or legal guardian, or (b) through and under the supervision of a school or training institution (such as an FAA Part 147 aviation maintenance program) that has authorized the user’s access and is responsible for obtaining any parental or guardian consent required by law. We do not knowingly create accounts for, or collect personal information from, children under 13. If you believe a child under 13 has provided us personal information, contact us at [TBD — privacy contact email] and we will delete it.To use most features you must create an account using a valid email address. You are responsible for the accuracy of your account information, for keeping your login credentials confidential, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.3. Subscriptions, Billing, Free Trial, and Cancellation
3.1 Plans and pricing
The Service is offered on a per-test basis for each of the three FAA A&P knowledge tests (General, Airframe, and Powerplant). Each test may be purchased as a recurring auto-renewing subscription of $15 per month or as a one-time lifetime purchase of $79, in each case for the applicable test. All three tests may also be purchased together as a one-time lifetime bundle for $149, a founding price available to the first 250 students, after which the bundle's list price is $199. New subscriptions may begin with a 7-day free trial that requires a payment method to start.Prices are stated in U.S. dollars and exclude any applicable taxes, which may be added at checkout. We may change our prices on a going-forward basis; any price change will not affect the price of a subscription period you have already paid for.3.2 Free trial
We may offer a 7-day free trial that requires a payment method to start. If you start a free trial, you must provide a valid payment method. Unless you cancel before the trial ends, your subscription will automatically begin and your payment method will be charged the then-current subscription fee. You may cancel at any time during the trial to avoid being charged.3.3 Automatic renewal and authorization to charge
Monthly subscriptions automatically renew for successive one-month periods until you cancel. By starting a subscription (including after a free trial), you authorize us and our payment processors to charge your payment method the then-current subscription fee at the start of each renewal period, until you cancel. A one-time lifetime purchase is a single charge for ongoing access to the applicable test and does not automatically renew.3.4 Cancellation
You may cancel a subscription at any time through your account settings (or, for purchases made through a mobile app store, through that store’s subscription management). When you cancel a recurring subscription, the cancellation takes effect at the end of the current paid period: you keep access to the paid test through the end of the period you have already paid for, and you will not be charged again.3.5 No refunds
Except where required by applicable law, all payments are non-refundable, and we do not provide refunds or credits for partially used subscription periods, unused access, or one-time lifetime purchases. Cancelling stops future charges; it does not retroactively refund amounts already paid.4. Acceptable Use
You agree not to, and not to permit anyone else to:•copy, scrape, harvest, republish, sell, sublicense, or otherwise distribute the questions, answers, explanations, or other content in the Service;
•reverse engineer, decompile, or attempt to derive the source code or underlying structure of the Service, except to the extent this restriction is prohibited by law;
•share, resell, or provide access to your account to others, or use a single account on behalf of multiple people;
•use automated means (bots, scripts) to access the Service or interfere with its normal operation, security, or other users’ use;
•use the Service for any unlawful purpose or in violation of these Terms.
5. License to Use the Service; Our Intellectual Property
Subject to these Terms and your payment of applicable fees, Aviation Learning Solutions grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your own personal, non-commercial test-preparation purposes.The Service and all content we provide — including questions, answer keys, explanations, images and figures, software, design, text, and trademarks — are owned by Aviation Learning Solutions or our licensors and are protected by intellectual property laws. Except for the license granted above, we reserve all rights. “FAA,” “Airman Certification Standards,” and references to FAA tests are used for identification only; we are not affiliated with, endorsed by, or sponsored by the Federal Aviation Administration or any government agency.6. User Content and Feedback
The Service does not provide general public-facing content posting in its current version. If you submit feedback, suggestions, or other materials to us, you grant Aviation Learning Solutions a perpetual, irrevocable, royalty-free, worldwide license to use them without restriction or obligation to you. You are responsible for any information you provide and represent that you have the rights to provide it.7. Study-Aid Disclaimer — No Guarantee of Exam Results
The Service is a study aid and practice tool only. It is not an official FAA product, is not an authoritative source of FAA regulations or testing materials, and is not a substitute for FAA handbooks, advisory circulars, regulations, an approved training program, or the advice of a certificated instructor.WE DO NOT GUARANTEE THAT USING THE SERVICE WILL CAUSE YOU TO PASS ANY FAA WRITTEN, ORAL, OR PRACTICAL TEST, OR THAT THE CONTENT MATCHES ANY CURRENT FAA TEST. ACTUAL TEST QUESTIONS, FORMATS, AND STANDARDS ARE SET BY THE FAA AND MAY CHANGE. YOU ARE RESPONSIBLE FOR VERIFYING CURRENT REQUIREMENTS WITH OFFICIAL FAA SOURCES.8. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT CONTENT IS ACCURATE, COMPLETE, OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVIATION LEARNING SOLUTIONS LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FAILURE TO PASS ANY EXAM, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.10. Indemnification
You agree to indemnify and hold harmless Aviation Learning Solutions and its owners, officers, and employees from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.11. Suspension and Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Upon termination, your license to use the Service ends. Sections that by their nature should survive termination (including payment obligations, disclaimers, limitation of liability, and indemnification) will survive. Termination does not entitle you to a refund, except as required by law.12. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules, and, where applicable, by U.S. federal law. The state and federal courts located in Michigan will have exclusive jurisdiction over any dispute.13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by email or an in-app notice) and will update the “Effective date” above. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.14. Contact
